In compliance with the provisions of Article 3.8 of the Spatial Planning Act, the mayor and aldermen of Edam-Volendam announce that the council has adopted the zoning plan “Oorgat 6/6a Edam” in its meeting of January 26, 2023. This plan consists of the geometrically determined plan objects as contained in the GML file, NL.IMRO.0385.bpOorgat6Edam-vg01 and the associated explanation, imagination, rules and appendices to the explanation. The opinions have not led to changes to the zoning plan, but have led to additions to the explanatory notes to clarify matters. The adjustments compared to the draft zoning plan are explained in more detail in the memorandum of response to the views Zoning plan “Oorgat 6/6a Edam”.
Planning area
The project location is located in the southeastern part of the municipality of Edam-Volendam and relates to the Oorgat6/6a plot in Edam.
Goal
This zoning plan makes it possible to realize a civilian home and a residential care complex with 26 care units for the elderly with dementia, patients with fragile health and a need for terminal care at the current business location.

Equal authority accrues to an interested party who demonstrates that he was not reasonably able to make his point of view known in time. An interested party can also lodge an appeal against the changes made to the draft zoning plan when it was adopted.
Digital profession

Preliminary injunction
Lodging an appeal has no suspensive effect. The person lodging an appeal can therefore also submit a request for provisional relief to the President of the Administrative Jurisdiction Division of the Council of State.
There are costs associated with lodging an appeal and a request for interim relief.
Crisis and Recovery Act applies
Because this zoning plan makes the construction of more than 26 residential care units planning possible, Section 2 of Chapter 1 of the Crisis and Recovery Act applies. This entails that special procedural provisions apply to any appeal proceedings to be instituted before the Council of State.
All grounds of appeal must be included in the notice of appeal. No new grounds of appeal may be put forward after the appeal period has expired. The appeal is declared inadmissible if no grounds are submitted within the appeal period.

Entry into force zoning plan
Pursuant to Article 3.8, paragraph 5 of the Spatial Planning Act, the decision to amend the zoning plan takes effect on the day after that on which the appeal period expires. If, during the appeal period, a request for interim relief is also submitted in addition to a notice of appeal, the decision will not take effect until a decision has been made on that request.
